01:32:37 this afternoon we will not be hearing when Gary MERS took up a tenancy at granvel Tower we will not be hearing about which floor he lived on or which
01:32:50 about which floor he lived on or which flat he lived in we will not be hearing any of that because Gary MERS was not a resident of grenfell tower Gary was a West London boy born
01:33:01 tower Gary was a West London boy born and bred he had friends who he'd visit and socialize with who were residents of grenfell Tower and on that night the 14th of June
01:33:12 14th of June 2017 that is exactly what Gary had been doing visiting a friend Debbie lamil at grenfell

01:33:28 return Gary was born on the 4th of January
01:33:33 January 1960 in London and lived in North Kensington all his life he was the eldest of four children he was the only boy and he and his mother Joan shared a

01:33:46 special bond Gary was a much loved Son brother father uncle grandfather Grand uncle and
01:33:59 grandfather Grand uncle and friend he was 57 years of age when he died and he was survived by his mother Joan sisters Lorraine Tammy and Anne and

01:34:12 children Scott Amy Aaron and his youngest sister who were just 14 and N respectively at the time of the fire his grandchildren

01:35:08 2000s Gary became a painter and decorator and he had a thirst for learning he was outgoing and quick witted at the commemoration hearings the family spoke eloquently about the person that Gary

01:35:33 two youngest children Anna recalled at those hearings how their early years as a couple were filled with happiness and laughter Gary was a devoted and loving father to his children and indeed he
01:35:45 father to his children and indeed he considered his children to be the greatest achievement of his life he was physically and verbally very affectionate to them them and they knew how much he loved them as a
01:35:56 how much he loved them as a result Gary was the life and soul of everything he did and everywhere he went he had a great sense of humor in her remembrance of Gary his sister tamy said
01:36:10 remembrance of Gary his sister tamy said addressing her brother directly I hope you're with dad still nagging his ear off as he always did Tammy paid special tribute to the
01:36:21 did Tammy paid special tribute to the bond that Gary and his mother had she said that their mom always supported him and had his back they spoke every day in the video played at the

01:36:44 and she felt you could never be sad not when he was around Tammy herself loved the relationship that Gary had with her own children and his funloving nature he loved music and especially the
01:36:57 he loved music and especially the legendary soul singer Marvin Gay his nieces kenita and Chanel gave us a very very Vivid pen portrait at that commemoration
01:37:09 commemoration hearing they told us that Gary was a man with values and a huge character they spoke of how involved he had been in their lives when they were growing up and the bonds that he formed not only
01:37:22 and the bonds that he formed not only with them but the Next Generation ation of the family kenita remembers the close relationship that Gary had with her children his nieces also remembered how they were sometimes on the receiving end
01:37:34 they were sometimes on the receiving end of his jokes and shared memories of how the entire family would spend Christmas together and the tradition of sitting around the kitchen table playing cards Gary took great pride in his
01:37:47 cards Gary took great pride in his appearance never a crease out of place he was a sharp dresser and used to joke I still got it ain't I his home was equally Immaculate and he took great
01:37:59 equally Immaculate and he took great care to make sure everything was neat and
01:38:02 and tidy that was the man that Gary MERS
01:38:07 was he lived not at grenfell towers as I said he lived at 75 Lancaster Road North Kensington and on that fateful night he
01:38:18 Kensington and on that fateful night he had been together with his friend Debbie lamel in her flat flat 161 on the 19th floor when the fire broke out sir you and the panel will recall
01:38:31 out sir you and the panel will recall from the presentation of the evidence in relation to Debbie um by Mr fredman Queen's Council last week that she had returned home from work at Holland Park
01:38:43 returned home from work at Holland Park Opera that evening on the 13th of June and was seen in the lift loby about 2257 she had texted her mom just after 11 confirming that she was home
01:38:56 11 confirming that she was home safely Gary is not seen on the CCTV footage in the lift lobby area that evening which would suggest that he had perhaps spent the day at grenfell
01:39:09 Tower the events of the night itself the 19th
01:39:16 19th floor so you will also recall that fuma Ahmed who was living in flat 164 had left her flat after receiving a call
01:39:27 had left her flat after receiving a call at 120 from her cousin telling her that the outside of grenfall tower was on fire so it may be useful just to remind ourselves at this point of that floor
01:39:39 ourselves at this point of that floor plan from the 19th
01:39:44 Floor thank you and we can see flat marked one which is the flat own um wherein Debbie lamel
01:39:55 is the flat own um wherein Debbie lamel and Gary MERS had been spending that evening at the time the fire broke
01:40:03 out you can see sir that flat 164 was on the west side of the tower fuma said that she saw Debbie and Gary when she
01:40:14 that she saw Debbie and Gary when she came out of her flat Debbie was standing opposite the two lifts near the C cupboard doors and said that people were going up upstairs fuma describes the conditions
01:40:26 upstairs fuma describes the conditions in the lobbies as follows it was full of thick dark gray smoke it was dark and steamy and making it hard to see very
01:40:37 steamy and making it hard to see very far she also said the smoke smelted like gas and chemicals which burnt her eyes fiduma recalls opening the door and going into the stairway which had less
01:40:48 going into the stairway which had less smoke than the lobby at that point she also recalls that they walked slowly up the stairs and they did not see anyone else between the 19th and the 23rd
01:41:01 floor again sir we've heard extensive evidence about the upward migration of a number of people to the 23rd floor we know that Gary traveled with
01:41:14 floor we know that Gary traveled with Debbie lamel from Flat 161 up the stairs to the 23rd floor and they were among a group of people
01:41:26 and they were among a group of people that took refuge in Moses Bernard's
01:41:36 Flats Debbie and Gary were initially standing in the corridor before taking refuge in flat 2011 in her account again fuma stated
01:41:49 2011 in her account again fuma stated they were standing in the corner of the flat crowded around the entrance door and the hallway she said they felt trapped between the fire in the living room that had broken out through the
01:42:00 room that had broken out through the window and the thick smoke coming in from the
01:42:05 from the lobby at some point Debbie and Gary was separated according to Debbie lel's timeline she made a 999 call at
01:42:17 timeline she made a 999 call at 0134 and 44 seconds lasting around about minutes
01:42:23 minutes that was connected to the BT exchange Debbie reported being in someone else's flat and it would appear that the fire had broken into the flat by that stage
01:42:34 had broken into the flat by that stage as the caller is heard saying look if fire is B burning and there's a command to get the dog get the dog presumably that being Marley Moses's
01:42:46 dog presumably that being Marley Moses's dog away from the fire the call is somehow then disconnected and reconnected at Z 13922 this time lasting for a minute and
01:42:57 13922 this time lasting for a minute and a half it is during this call that Debbie and Gary become separated from each other the call does not appear to have been connected properly because the
01:43:09 have been connected properly because the operator doesn't speak and instead it is an automated recording throughout Debbie comes on to the call and one can hear her saying and calling
01:43:20 and one can hear her saying and calling repeatedly Gary Gary the call then disconnects again and reconnects a few seconds later this time it lasts for 2 minutes
01:43:31 later this time it lasts for 2 minutes and 45 seconds again it is the automated recording that we hear Debbie continues to call for Gary And is heard saying I'm telling you no
01:43:43 And is heard saying I'm telling you no one's coming up whilst we do not know for certain how and why Debbie and Gary became separated we do know from the timings of that BT
01:43:55 we do know from the timings of that BT exchange call that they were separated sometime around
01:44:04 0139 at that time we also know that the conditions in flat 201 Moses Bernard's flat had been rapidly deteriorating the occupants were
01:44:16 deteriorating the occupants were affected by the impact of smoke and the ever encroaching fire it was appear that the fire had broken into the flat at that stage via the
01:44:27 the window given the reported smoke conditions and fire as well as Debbie repeatedly calling for Gary visibility in the flat must have been exceptionally poor at this stage and dis significantly
01:44:42 poor at this stage and dis significantly worsening when at 0141 Debbie makes a further call this time connected to the C control room she was in the bedroom and reported that she was able to see
01:44:54 and reported that she was able to see because the smoke was so thick conditions in the lobby at this time Gary and the other occupants were
01:45:05 time Gary and the other occupants were also being affected by thick black smoke from the
01:45:08 from the lobby the inquiry was reminded last week during the presentation of Rana Ibrahim of her Facebook live stream which started around
01:45:19 started around 0138 and ran for 6 minutes and 33 seconds
01:45:23 seconds it showed the conditions inside her flat and the lobby and at around 1 minute 14 into the
01:45:31 into the stream it is worth noting and highlighting a few extracts from that stream which may offer some insight into Gary's
01:45:41 Gary's movements the stream opened with Ria saying oh God we then hear another woman saying don't open the door don't open the door you're letting smoke in
01:45:55 in Arabic Ria says there is a fire in the
01:46:01 building ra then says I'm scared maybe someone's
01:46:08 someone's outside another female voice is heard saying they're in another flat Ria replies are you sure the female replies they've gone to the other flat that was
01:46:21 they've gone to the other flat that was open we then hear loud banging and Ria opens her door again shouting hello come here hello
01:46:33 shouting hello come here hello hello pausing there if I may I'd like to remind us all of the phase one report Volume 2 paragraph
01:46:46 Volume 2 paragraph 1132 at that paragraph there is an image figure 11.9 a capture from Ria's Facebook live stream at around this time
01:47:01 0139 it's when she goes from the lobby from her flat into the lobby the report says this in relation to that
01:47:11 to that image at this point the camera is facing towards the lobby a light in the ceiling of the lobby is on and the Darkness is that area that appears to be caused by
01:47:26 that area that appears to be caused by smoke that image is striking in its Darkness an almost entirely black screen only illuminated by the Blurred outline
01:47:37 only illuminated by the Blurred outline top and center of the lobby ceiling light looking like some strange Apparition caught on camera in the darkness this is what the residents on the 23rd floor were confronted with in
01:47:50 the 23rd floor were confronted with in their lobby at 0139 one can only imagine their confusion Their Fear and their desperation returning then to Ria's live
01:48:03 desperation returning then to Ria's live stream having said those words hello come here hello hello we then hear Gary's voice he says and this is at 056 of the live stream
01:48:16 and this is at 056 of the live stream I'm here I'm here R replies come come quick quick there's a respon that's unclear from Gary and then we hear banging and Ria
01:48:27 Gary and then we hear banging and Ria saying hello here here here Gary then responds thank you there's some discussion then between
01:48:38 you there's some discussion then between Ria and a male voice not Gary's about closing the door but Ria is concerned that there may be more people outside and says again come here at that
01:48:50 outside and says again come here at that point we can hear Marco bardi he says no we are we're here we are inside my apartment it's clear that Ria is doing
01:49:05 apartment it's clear that Ria is doing her best to try and find out if anyone else is out there in the darkness to offer them refuge in her flat Gary answers that call for refuge and with a
01:49:18 answers that call for refuge and with a banging noise he follows the sound and he ends up in flat
01:49:27 203 there is then on the live stream loud banging heard in the background along with the sound of the vents farad nether in his evidence had said that he
01:49:39 nether in his evidence had said that he had phoned the TMO around about 10 1 because the vents were so loud and he told us that they were positioned between Flats 202 and 203 on one side of
01:49:51 between Flats 202 and 203 on one side of the building and Flats 205 and 206 on the other given the timing of 0139 it is likely that the banging herd was fuma Ahmed because we know from her
01:50:04 was fuma Ahmed because we know from her evidence that she was banging on the metal door to the roof that was padlocked she said she'd heard the helicopter and was banging the metal door because it was padlocked and she'd
01:50:16 door because it was padlocked and she'd hoped that somebody could hear her she described the smoke getting thicker and thicker in the stairwell until she could not see the stairs under her feet one can make only informed guesses
01:50:28 feet one can make only informed guesses and inferences as to exactly what Gary did after saying those words to Ria on the live
01:50:35 the live stream it may have been the case that amidst the noise of the vent for dumer banging on the metal door in an effort to attract attention that Gary left flat
01:50:47 to attract attention that Gary left flat 2011 to investigate whether there had been a rescue being a non-resident he would not be familiar with the layout of the 23rd floor and may have gotten lost
01:50:58 the 23rd floor and may have gotten lost trying to navigate his way through the smoked fil Lobby then hearing Ria's call for Refuge he took that
01:51:09 he took that up inside flat 203 again from Ria's recording we know that it continues after Gary goes into the flat itself but he's not heard on
01:51:22 the flat itself but he's not heard on the recordings after that and he's not seen on any of the footage during R's presentation we heard of the deteriorating conditions within flat
01:51:35 flat 203 Gary himself made no calls to the emergency services that
01:51:41 night it is important perhaps to consider the following key aspects of that
01:51:48 that timeline at 2:05 isra Ibrahim reported in a 999 call that smoke was entering the flat so they had closed the doors
01:51:59 the flat so they had closed the doors and moved to the living room and the kitchen area they had kept the windows open so that they could breathe and the smoke was not entering through the windows at that time at
01:52:12 windows at that time at 0240 there was increased smoke exposure to the South face of the tower spreading across flat 203 at 024 2 isra ibrahim's 999 call um
01:52:26 203 at 024 2 isra ibrahim's 999 call um she reports that the smoke had now entered flat 203 from the lobby and from outside they were now forced to close the windows because of the burning in
01:52:39 the windows because of the burning in the flat next door 202 it is perhaps useful at this point sir to remind ourselves of Professor P's evidence and his analysis of the uptake
01:52:50 evidence and his analysis of the uptake of aient gases Gary mour had entered flat 203 around about
01:52:58 about 13940 a.m. and based on Professor P's evidence he then became effectively trapped in flat 203 by the smoked fi
01:53:11 trapped in flat 203 by the smoked fi Lobby during the 2-hour period up to 311 there was some slow smoke infiltration into the flat from the lobby but Gary and the other occupants
01:53:22 lobby but Gary and the other occupants were able to avoid significant exposure by Sheltering in less affected rooms and opening Windows until the smoke started to flow past outside and the windows
01:53:33 to flow past outside and the windows were closed once the exterior fire spread outside the bedrooms from around 0311 to
01:53:41 0311 to 0320 there was increased smoke and toxic gas penetration into the flat by Sheltering in other areas such as a living room the occupants were able to
01:53:52 living room the occupants were able to limit their uptake to some extent by approximately 17 to 26 minutes later around the time the exterior fire spread
01:54:03 around the time the exterior fire spread was now outside the living room the O occupants had started to accumulate a substantial but not at that point sub incapacitating dose of axient gases that
01:54:16 incapacitating dose of axient gases that would have continued until around 0350 from approximately 0337 as the exterior fire started to
01:54:27 0337 as the exterior fire started to spread past and penetrate the living room on the south and then the West sides of the flat and as the smoke and gases conditions in the room
01:54:38 gases conditions in the room deteriorated that deterioration would have been
01:54:42 have been rapid Professor perser considered that had Gary and the other occupants of flat 203 attempted to evacuate at that time 350 it is likely they would have
01:54:55 350 it is likely they would have collapsed after descending several floors he bases this upon the um Co HB measurements of abas ibraim which was
01:55:08 measurements of abas ibraim which was about 20% cohb at 350 that's a significant but not sub incapacitating concentration and his estimate of the high concentration of Co
01:55:19 estimate of the high concentration of Co in the lobby and moderate concentration of of Co in the stairs at this time so what are we to make of
01:55:30 time so what are we to make of that as professor perser says by 350 it is unlikely that Gary and the other occupants of flat 203 would
01:55:41 the other occupants of flat 203 would have been able successfully to self-
01:55:48 evacuate Gary's remains were recovered from Flat 20
01:55:55 three the location of his remains suggests he died in the
01:56:01 bathroom the anthropological findings also indicated some signs of osteoporosis and age related conditions it's unclear from this um evidence
01:56:13 it's unclear from this um evidence whether or not and to what extent this would have impacted on Gary's ability to self- evacuate down several light of stairs from the 23rd
01:56:25 stairs from the 23rd floor Professor perser considers that he would have been Sheltering when he died he also considered by Sheltering in the enclosed
01:56:36 considered by Sheltering in the enclosed areas of the flat furthest away from the rooms with exterior windows exposed to the fire Gary would still have been exposed to the P penetration of toxic smoke but he would
01:56:49 penetration of toxic smoke but he would have been less exposed to heat and and it is most likely that he died before the fire consumed the flat in terms of time of death Professor
01:57:01 flat in terms of time of death Professor perser estimates that the approximate bracket for the time within which it is likely that Gary would have died is between 420 and 440 Dr fanel the pathologist agrees with
01:57:15 440 Dr fanel the pathologist agrees with that approach of an approximate time or window of time when recording deaths would be appropriate
01:57:24 as I said at the outset Gary mes was not a resident of grenfell tower he didn't live there he was visiting his family therefore had no reason immediately that
01:57:36 therefore had no reason immediately that night to be concerned for his safety why would they be they were unaware that he was even there until they came across information
01:57:47 there until they came across information and footage circulating on social media that was a particularly cruel way to make that
01:57:56 make that discovery on the 14th of June kenita Spence reported her uncle missing to the Metropolitan Police casualty Bureau and thereafter she and Chanel had the
01:58:08 thereafter she and Chanel had the experience similar to so many others that we've heard of in the previous module of trying to find out accurate information about their uncle Gary and
01:58:20 information about their uncle Gary and the difficulties they encountered in doing
01:58:25 so Gary's identifi identification was confirmed via dental records on the 29th of
01:58:34 June in terms of the medical cause of death the initial medical cause was confirmed by Dr Benjamin Swift on the 27th of March 2018 as consistent with
01:58:46 27th of March 2018 as consistent with the effect of fire now Dr fanel in considering the appropriateness of recording the medical cause of death as a fixer from its fient
01:58:57 cause of death as a fixer from its fient gases or inhalation of such gases in the light of Professor P's analysis concluded that given the limited pathological material available to him
01:59:08 pathological material available to him um he could not do so and that the appropriate medical cause of death to be recorded was consistent with the effect of
